Similarly, we do everything possible to respect the commitments we make to our customers, both in terms of order processing, delivery logistics and the quality of our products.

General conditions

Preamble :

The customer acknowledges having read the general conditions of sale set out below.

Validation of any order constitutes acceptance thereof, without any reservation.

The conditions of sale appearing as follows, prefigure the contractual relations between Chiccharms and its customer. This contract is accepted by both parties when placing an order. The rules set out herein shall prevail over any other document whatsoever.

Orders:

The e-commerce solution that we have adopted is valid when registering the order, on the nature, date and time of the order, as well as on the payment.

Chiccharms undertakes to confirm the order to the customer by email, to the email address that has been communicated to him. The buyer undertakes to verify the accuracy of all the information that he has entered in his customer account. The seller cannot be held responsible under any circumstances for a lack of information linked to incorrect contact details.

The sale is only effective upon validation of the order and acceptance of payment.

An order corresponds to a single delivery address. If the buyer wants two deliveries to two different addresses, he must place two orders, each with a single delivery address.

While generally the majority of the products we present online are available in stock, it may happen that for various reasons, our stock updates are not done in real time. If the ordered jewel is not available in stock, Chiccharms will offer you a refund, an equivalent exchange, or a credit of the same value to be used in its online store. This proposal will be made by email, to the email address provided. The customer is therefore required to check their inbox. Whatever solution is then chosen, Chiccharms undertakes to carry out the operation within 10 working days following the order.

Rates and carriers:

The prices displayed in the product sheets are inclusive of all taxes (VAT, sea tax and other possible taxes) but do not include shipping costs. These must be added before finalizing the order. Deliveries made to countries outside the European Community may be subject to various fees and taxes, including customs fees and import VAT. These costs are borne exclusively by the buyer.

Acceptance of the order also constitutes acceptance of the selected carrier. If for any reason Chiccharms considers that this carrier is not the most suitable for the delivery of a given order, the customer will be notified by email, and a different choice will be mutually agreed.

Payment :

Chiccharms offers you several secure payment solutions on the internet:

  • PAYPAL , one of the most secure payment solutions on the internet, offers you the possibility of paying by credit card or directly via your PAYPAL account, in a secure environment.
  • Bank transfer (from account to account)
  • Payment by check (Metropolitan France and Reunion only)
  • Bank Card: Solution of Payplug payment built around the 3D Secure protocol from Visa and Mastercard, offering security and a guarantee for any online transaction by bank card.

Regardless of the payment solution chosen, at no time will your banking information pass through our online store, they will be directly processed in an encrypted and secure manner from bank to bank via the server of our trusted partners PAYPAL, or BRED. Your banking details are not known to our services, and we have no way of accessing them and even less of keeping them.

In accordance with the provisions of the Civil Code on the conclusion of online contracts, the contract will be concluded when you click on the button allowing you to confirm your order, after having viewed the details of the order and in particular its total price, and having had the opportunity to correct any errors. You will thus acknowledge your obligation to pay.

Chiccharms reserves the right to cancel any order from a customer who has caused problems in terms of payment during previous orders.

Likewise, for any order awaiting payment (payment by check or bank transfer), the item ordered remains the property of Chiccharms until receipt and confirmation of the validity of the payment.

Chiccharms cannot be held responsible if an order is no longer available due to the delay in receiving payment. Chiccharms also reserves the right to cancel an order for which payment has not been received within normal timeframes.

You acknowledge that the "double click" associated with the checkbox on the acknowledgement of the general conditions constitutes consent to contract and constitutes an irrevocable and unreserved acceptance of the general conditions of the product. Unless proven otherwise, the data recorded by Oney Bank constitutes proof of all transactions between you and Oney Bank.

If you request to benefit from a financing solution offered by Oney Bank, the information relating to your order will be transmitted to Oney Bank, which will use it for the purposes of studying your request for the granting, management and recovery of credit.

Deliveries:

Chiccharms will use the information as it has been transcribed to it, cannot be held responsible in the event of non-delivery due to the entry of an incorrect recipient address.

Chiccharms undertakes to process any order within 48 working hours following its validation. If this deadline cannot be met, the customer will be informed by email.

Delivery will generally take place within the announced timeframes, but it may occasionally happen that for logistical reasons these times are extended. Chiccharms undertakes to inform its customer by email, if the malfunction is attributable to it. If the deadlines cannot be met due to the carrier chosen by the customer, Chiccharms cannot be held responsible for it.

Chiccharms will systematically provide proof of shipment, if provided with the selected mode of transport, on which will appear a tracking number that can be viewed on the carrier's website. We cannot be held responsible for any possible lack of tracking by the carrier linked for example to a scanning error, or to a computer bug on the carrier's website.

Chiccharms will use the information as it has been transcribed to it, cannot be held responsible in the event of non-delivery due to the entry of an incorrect recipient address.

Some force majeure elements may discharge Chiccharms of its delivery obligation: strikes, fires, riots, natural disasters, but also the impossibility of being able to supply correctly constitute a discharge from this obligation.

Photos:

All the jewelry offered for sale in our e-shop has been photographed by our services, and corresponds identically to the photo presented. It may happen that for reasons of optics or perspective the visuals may appear misleading as to the actual dimensions of the items. Chiccharms strives to communicate the dimensions of its jewelry as precisely as possible in each product sheet.

Returns and withdrawal:

Right of withdrawal

As required by the Hamon law ( law 2014-344 of March 17, 2014) governing mail order sales, the buyer has a period of 14 days to form an opinion on the product delivered. During this entire period, the latter can exercise his right of withdrawal.

You have the right to withdraw from this contract within 14 days after the day on which you, or a third party other than the carrier and indicated by you, acquires physical possession of the last good.

This deadline is deemed to have been met if you send back the goods before the 14-day period has expired. If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract.


Refund

We undertake to refund the returned product within 14 days. We may withhold reimbursement until we have received the goods back, or until you have provided us with proof of shipment of the goods, whichever is the earliest.

We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you expressly agree otherwise. In any event, this means will not incur any fees for you.

We will cover the direct costs of returning the item.

Consumer responsibility

You are only liable for any diminished value of the property resulting from handling other than what is necessary to establish the nature, characteristics and proper functioning of the property.
